You acknowledge and undertake that you are accessing the services on the website and transacting at your own risk and are using your best and prudent judgment before entering into any transactions through the website. You further acknowledge and undertake that you will use the website to order products only for your personal use and not for business purposes.

We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. Every computer monitor/mobile screen display is different and as such sometimes the colour of the actual product may vary from the image as seen on your mobile/computer screen.

  1. TRANSACTIONS AND CANCELLATIONS
  • Payment

While availing any of the payment method/s offered by us, we are not responsible or take no liability of whatsoever nature in respect of any loss or damage arising directly or indirectly to you out of the decline due to lack of authorization for any transaction/s, or exceeding the present limit mutually agreed by you and between your “Bank/s”or any payment issues arising out of the transaction or decline of transaction for any other reason/s.

  • Order Cancellation

Due to unavoidable circumstances there may be times when certain orders having been validly placed may not be processed or capable of being dispatched. Naarya Savyaja reserves the exclusive right to refuse or cancel any order for any reason. Some situations that may result in your order being cancelled shall include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information or any defect regarding the quality of the product. We will contact you if all or any portion of your order is cancelled or if additional information is required to accept your order. If your order is cancelled after your credit card/ debit card/ any other mode of payment has been charged, the said amount will be reversed into your Account/ as the case may be to the source of the payment within a period of 15 working days.

  • Taxes

You shall be responsible for payment of all fees/costs/charges associated with the purchase of products from us and you agree to bear any and all applicable taxes including but not limited to VAT/CST, service tax, GST, duties and cesses etc.

 

  1. SHIPPING AND DELIVERY
  • All products purchased from the website shall be delivered to the user by standard courier services by Naarya Savyaja. All deliveries where applicable shall be made on a best efforts basis, and while Naarya Savyaja will endeavour to deliver the products on the dates intimated, Naarya Savyaja disclaims any claims or liabilities arising from any delay in this regard.
  • Naarya Savyaja shall not be responsible for any delay in the delivery of the Products. Naarya Savyaja shall not be liable for any damage to the product in transit due to mishandling by the logistics partner.
  • An estimated delivery time shall be provided to you on confirming your order. On placing your order, you will receive an email containing a summary of the order and also the estimated delivery time to your location.
  • Sometimes, delivery may take longer due to inter alia:
  1. bad weather
  2. flight delays
  3. political disruptions
  4. other unforeseen circumstances
  • In the event any delay in delivery of a product is expected, Naarya Savyaja may, at its sole discretion, intimate you regarding such delay.
  • Naarya Savyaja shall not be held responsible and will bear no liability in case of failure or delay of delivering the products including any damage or loss caused to the products.
  • Where there is a likelihood of delay in delivery of the products, you may be notified of the same from time to time. However, no refunds may be claimed by you for any delay in delivery of the products which was caused due to reasons beyond the control of the website and/or the seller.
  • Naarya Savyaja shall not compensate for any mental agony caused due to delay in delivery.

 

  1. CUSTOMS AND INTERNATIONAL SHIPPING
  • Due to the nature of international shipping, occasionally a customer may have to pay additional import duties and taxes which are levied once a shipment reaches your country. The large majority of orders will not have to pay any additional fees. However, we are unable to calculate when and how much these infrequent customs duty charges will be levied. In the case where additional customs charges are assessed, you will be responsible for paying these additional fees. If you are presented with an invoice from the courier service provider for import duties and taxes, you will have to pay the courier service provider directly at the time of delivery.
  • The estimated time of delivery is within 15 to 30 working days for international orders.

 

  1. RETURN, REPLACEMENT AND REFUND
The Goods will be replaced only if it is damaged or defective. Also the Tag must not be removed or Damaged to avail refund Or Exchange policy of the product.
 
Note: The Exchange policy works 4 days from the Date of Purchase / Delivery. After 4 days no exchange or Refund will be provided.

 

  1. SHIPPING & PROCESSING FEE

The shipping cost is based on Delivery Speed, Location and Package Weight.

Regular Delivery

South india (2 to 5 days) – Rs. 100/kg

North india (5-7 days) – Rs. 150/kg

Express Delivery 

South india (next day) – 200/kg

North India (2 day) – 250/kg.

An average parcel tends to weigh 2 kgs.

 

  1. INDEMNITY AND RELEASE

You shall indemnify and hold harmless Naarya Savyaja and their respective directors, agents and employees, from any claim or demand, or actions including reasonable attorney’s fees, made by any third party or penalty imposed due to or arising out of your breach of these terms and conditions or any document incorporated by reference or your violation of any law, rules, regulations or the rights of a third party.

You hereby expressly release Naarya Savyaja and/or its affiliates and/or any of its representatives from any cost, damage, liability or other consequence of any of the actions/inactions of the vendors and specifically waiver any claims or demands that you may have in this behalf under any statute, contract or otherwise.

  1. SEVERABILITY

If any provision of these terms and conditions is held invalid by a court of competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions contained in these terms and conditions and the remaining portions of these terms and conditions shall continue in full force and effect.

  1. WAIVER

If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

  1. FORCE MAJEURE

Failure on the part of Naarya Savyaja to perform any of its obligations and the non-furnishing of the Service, shall not entitle you to raise any claim against Naarya Savyaja or be a breach hereunder to the extent that such failure arises from an event of force majeure. If through force majeure the fulfilment by either party of any obligation set forth in this Agreement will be delayed, the period of such delay will not be counted on in computing periods prescribed by this Agreement. Force majeure will include any war, civil commotion, strike, governmental action, lockout, accident, epidemic or any other event of any nature or kind whatsoever beyond the control of Naarya Savyaja that directly or indirectly hinders or prevents Naarya Savyaja from commencing or proceeding with consummation of the transactions contemplated hereby. You expressly agree that lack of funds shall not in any event constitute or be considered an event of force majeure.

  1. APPLICABLE LAW

Terms and conditions shall be governed by and interpreted and construed in accordance with the laws of India. The place of jurisdiction shall be exclusively in Bangalore.

This document is an electronic record in terms of Information Technology Act, 2000 and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000.

  1. JURISDICTIONAL ISSUES

Naarya Savyaja makes no representation that materials in the Website are appropriate or available for use in other locations/Countries other than India. Those who choose to access this site from other locations/Countries other than India do so on their own initiative and Naarya Savyaja is not responsible for supply of products/refund for the products ordered from other locations/Countries other than India, compliance with local laws, if and to the extent local laws are applicable.

  1. GRIEVANCE

We will provide a response within a period of 7 days from the date of such complaint/ grievance.

  1. EVENTS BEYOND OUR REASONABLE CONTROL

We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.
